Returned tablet damaged during delivery

I returned a tablet to Microsoft due to software issues (under warranty) and it was damaged during delivery, so they returned it to me with a note to say physical damage isn’t covered under warranty. I have picture and videos of the device that prove there was no physical damage that I sent to Microsoft Twitter support asking them for help. I can’t claim with UPS with proof of how the package arrived and all I have is the physically damaged device that was returned to me in new packaging.
It’s been really tricky getting hold of Microsoft support but finally someone emailed me yesterday and said they have sufficient proof and evidence that the device could not have been damaged during delivery but they can’t provide me with this without a court subpoena?! I don’t understand what proof they could have that shows it was sent damaged and I’m so angry they are accusing me of lying when I have proof of the device without any physical damage.
Can I claim with UPS without proof of how the package arrived? Why can’t Microsoft send me their “proof”? I’m at a loss for what to do next and can’t afford to be £400 down for damage I didn’t cause. Please help!

Did they arrange and book ups to collect the tablet?I didnt know we used subpoenas in the UK.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

As above. We don't use subpoena in the UK.
Are you in the UK?
Who paid for the return?0
