    We had a sale fall through on my OH's house. We decided to list with a second agent and told the first one we were going to do this, they could either continue to market it and charge us the same rate if they sold it, or lose it to the second agent. We told the second agent we would only pay the single agency rate, take it on or leave it. Both agents agreed to market the property at single agency rate. The first agent found the eventual buyer.

    Dual agency or a new agent is not going to help much if it is a quiet market - most people that are looking would already have browsed it on the portals; either you incur more fees in higher commissions or a lower price overall as the dual listing smells of desperation a bit.
    My complaint is that he said something to the buyer that he doesn’t know is true and has adversely influenced the buyer, 
    Sounds as if you looking to blame the EA for a lack of interest in the property. Rather than addressing the root cause. Which often boils down to price.

    As I posted earlier, we monitored similar properties in a five mile radius and kept competitive by matching price.
    We had a lot of interest so we don't accept price is a factor.
