Communal roof replacement

Hey everyone

I need advice. My roof needs repaired yearly because when the strong winds come, some tiles come off. I end up with water coming through my spare room ceiling.
I recently had a repair a few months ago.  It took a long time yo get repaired (about a year) because of covid-19. I own my flat in a block of 5 and one a shop. Im the top at two up and one at the bottom is council housing. Two flats are privately let.  I am in scotland.

The roof needs replaced according to the last inspection from the council. He said they (the council will only repair and not replace) . The council repair the roof because its an ongoing issue  and has a council tenants in the block and been going on since before i moved in (13years ago), because of this, its the councils responsibility to repair once reported and not my insurance. I get billed for my share

My question is, is there anything i can do about getting the roof replaced and not having to fit the whole bill then have to chase up neighbours for money. One of the landlords is a real piece of work.

Have you discussed with the other owners? You can only insist on maintenance being done - unless the whole roof actually needs replaced (what exactly does the report from the council say?) you cannot force the other owners to contribute.
  • It's a communal roof. Its not my space. It was verbal. Its unfair to assume because im at the top its my responsibility. Im constantly worried my roof will come in. I cannot pay for a whole roof replacement myself. Id lose everything. He said the beams etc indicate it needs replaced. I and 3 others are owned, one bottom flat is council. I've not as yet got an official quote but others i know who have had to do this, not in the same situation as me have had to pay thousands.
  • Is there a factor for the block?  It could be the council.  They would be responsible for arranging works.  If there is no factor, you will need to refer to your title deeds to see where the responsibility to pay for these things lies.  If it is a shared cost, you will need the agreement of the other owners before anything can be done.

You're in Scotland...? Very different kettle of fish to England. I suspect you'll get a lot of replies from people who don't notice that bit thrown in at the end...

No factor. I will get another repair but that will be £1000 (my share) in 3months. I will check deeds and maybe get a free assessment or something then speak to neighbours

But a banker, engaged at enormous expense,
