    Holiday was not cancelled my insurance would have been void if I travelled against foreign office advice. Love Holidays refunded for hotel but not flights as flight went.  I rang hotel prior to departure and informed by them closed due to covid

    The point I was making was that it's not necessarily as simple as that, and the outcome can be dependent on the nuances of the circumstances leading to the cancellation.  The quoted sections of the PTRs grant customers cancellation rights, with full refund obligations on the provider, in certain scenarios, and until more is known of exactly what happened in this case, it isn't viable to generalise....
    Sorry, I mean the same as you but my reply was overly simplistic. What I should have said was, it will come down to whether the customer simply asked to cancel their holiday, or whether Love Holidays couldn't provide said holiday. 

    "hello, I'd like to cancel my holiday please"

    "hello, I know my hotel will be closed, and you have not offered a suitable alternative, therefore I would like to cancel my holiday please"

    Might appear the same question, but would likely yield two very different results.

    So did love holidays know this? Did you give them a chance to provide alternative hotels? Or inform them hotel was closed?

    You state holiday was not cancelled? Was it a package holiday?  ABTA  covered.

    What conversation did you have with LoveHolidays at the time? What did they say when you informed them you knew the hotel would be closed?

    It sounds like it's been processed as a customer cancellation. The hotel element of the package was refundable, but the flights weren't so as per the T&Cs for customer cancellation that's what you've received.

    However as @eskbanker points out. If the hotel was closed then LH should have offered an alternative. If they didn't or were unable to do so, then they can't provide the package and as such should refund in full as per the PTR's 2018.

    But it sounds like it didn't get to that as they considered it as you cancelling.

    We were given vouchers from Italian rail from our cancelled trains which will run out this month. Can’t get in touch now! Does anyone know if there’s anything I can do now?

    Not sure why you have hijacked this thread.
    Simple answer however would be to continue attempt to make contact perhaps understanding that there may be delays with answering messages.
    If you are seeking others in a similar position you would be better starting your own thread.

    Love Holidays take the view that , in many cases, any flight refund has to come from the airline.

    They resigned from ABTA in September 2020 over differing opinions on refunds.
  • Hi All I'm looking for some help. August 2020 i had easyjet flights booked to majorca, due to covid i moved them to 2021 it cost me £75ish. better than losing them i thought. Easy jet have now cancelled the august 2021 flights and only refunded my £75 - do i have any rights to claim back the original £500 cost? or is that gone for good.
