Section 24 rights on a car being purchased on Credit?
Options
HI all,
We are in a dilemma, we purchased a Ford Kuga in Oct 2018 using their Ford Credit, we basically gave back our 2016 focus which we were also buying on Ford credit and swopped for the Kuga as realised we needed a bigger car.
Since we have had the Kuga is has been back in Nov 2018 due to a faulty centre console which they said they had fixed but then we had to take it back again in Dec 2018 as still going wrong (I had to video what was happening for them to believe me!) so they completely replaced the console.
Then we had the first year service in 11/19
In Jan 20 the engine management light came on and the car was very shuddery and smelt of rotten eggs. They had the car a week and told us it was a blown spark plug (took them a week to work that out!) but car was not longer covered under warranty but they carried out the repair as a gesture of good will as spark plugs shouldn't go on a vehicle of the age it was.
Roll on July 20 and the same thing happens again car goes back after 2 weeks of them having the vehicle was told it was spark plugs and fuel injector - they replaced and we took vehicle back.
Then we hit Oct 20 and yep you've guessed it same problem again after waiting 3 weeks for them to actually have a space in the diary to look at the car back it goes. 5 weeks later we get the car back they had been in talks with ford technical they have done countless tests on the vehicle. They have replaced all spark plugs and injectors again oh and gave us the 2nd service FOC because we told them to carry it out whilst they had the vehicle.
So you would have thought great car fixed nope Dec 10th (exactly!) the same fault occurs less then 4 weeks after us having the car back. If i had been thinking straight at the time I probably wouldn't have let them fix it again but had lots of other things going on at the time. So we just sent it back AGAIN! They actually collected the car from us this time as we were isolating and after much coming and goings they collected the car on 17th Dec. We just kept getting updates of Ford Technical are asking us to test this and then they took on test runs and we even agreed to let an engineer take it home for a week so he could see if things they had done worked. Then on 28th Jan we get a phone call to say that ford had agreed for them to replace the engine as they basically had decided it was a base engine fault and they didn't really know what the problem was. We wasn't happy about this as a 2yr old car shouldn't need an new engine. Took some advice and was basically told that we had to accept the repair and then go down a compensation route from Ford Credit due to the inconvenience caused. We had already started a complaint with Ford Credit on 13th Jan.
So yesterday I went to pick the car up - service manager assured me nothing could go wrong with the car as everything that could be replaced has been replaced........ Yep drove the flaming thing this morning and only got 1/2 mile down the road and the engine management light has come on! Yes I cried and screamed at my husband.
I have spoken to Ford credit as I last spoke to them on 28/1 about the complaint and wanted to know where we are at and what I should do as it has gone wrong again - it was them that advised me I had to accept the repair. Hubby phoned the dealership and they were very apologetic and said they'd get someone to come and pick the car up straight away. Then I got some free legal advice (the stuff you get with insurances etc) and they advised me not to give them the car but to look at going down the Section 24 final right to reject. So after all that my question is - has anyone done this with a car purchased under a credit agreement? If so how did it work with refunds etc. Obviously a very big decision for me to make as will basically be making ourselves carless (no way I will enter straight into a new agreement with Fords or with that dealership).
Has anyone any advice on what our next move should be - do I tell the credit company this is what I am thinking of doing? The man arrived to take my car but I sent him away to give me some breathing space,
I am open to all suggestions and help as I am at a loss of what to do now.
sorry for being so long but its been a long journey but not actually in our car or going anywhere!
