Laptop help

Hi I bought a laptop in Nov for Christmas , was for my son, I got it Amazon marketplace advertised Brand New Argos and Manufacture warranty for a year, My son got it for Christmas and it was working fine until a few weeks ago it started clicking and won’t boot up, I got told was the hard drive and contacted the seller who told me to get it fixed as wasn’t his problem hard drives go or it’s been dropped which I know it hasn’t. Anyway I went onto the Acer website as under warranty put details in to find that the warranty ended April last year? Contacted seller and again told me nothing he would do as past the time can send it back and Amazon won’t do anything.
Ive contacted amazon who have told me to send it back to the seller for a refund so I’ve sent it back fully tracked but the seller is not accepting delivery. If he refuses to accept the delivery I was just wondering where I stand?

Amazon have said if I don’t get a refund after 3 days off the seller to message them but does that include if he doesn’t accept the item?

Thanks I sent it back to him today Amazon’s instructions fully tracked but he’s refused delivery?I paid via PayPal , was a 1T hard drive
