  • This is indeed the neighbour with the privy. I know they want it back, which presumably puts us in a fairly good position for negotiation, especially considering the nephew has no intention of living in the house. I’m just not clear on how we’d go about legalising it. In the BEST scenario we’d give them the privy, we’d clarify the boundary and maybe, if it’s possible convert the RoW into a permissive footpath or some such, I doubt that’ll happen though.

    Why wouldn't it happen? The privy ROW is a huge issue for their property, given it's so close to their house. It's not just the restriction it places on extensions, it's also the potential intrusion that would make the property exceptionally difficult to sell.

    I should imagine there is a good chance they would confirm the boundary in return for you giving up that ROW. They would probably also agree to remove their ROW over your land unless it's their only exterior access to their garden (?).

    I'm not massively concerned about their RoW over our property, as long as it's used only as intended, occasional access to their garden and not the main thoroughfare to their garden.

    I went on the land registry today and paid to look at next doors Title deeds and plan
    Here it is ... the kink in the LHS boundary is the privy that 'belongs' to #15(the house we're interested in)
    This shows #15 (it's from 2009 so fairly accurately represents what's actually on the ground) and quite a clear boundary.
    So whoever buys #16 next ... this is what they're buying.

    When you compare this to the 'clearest' document we've seen for #15... it's from 1964 and shows the houses as they used to be ...

    It's this wiggle we're not sure of 

    The dotted lines are the original RoW, though this has altered to allow for the extensions seen in the top image... 
    Our house as yet isn't registered on LR and hopefully we can essentially use the boundary of #16 (top image)as our boundary .... not really sure how that works though, presumably that's down to the solicitors.
    We feel quite a bit happier having seen this, and knowing the neighbour wants the privy back, we think this can be sorted fairly well ... fingers crossed !

  • Things are moving, albeit slowly, we've got our plan back and it now matches the good one above :)
    The only thing we're waiting on now is an EICR we're paying for just to check the electrics are, at the very least, safe. This is being carried out tomorrow and and as long as it comes back reasonable, we're ready to exchange.
    If it needs a full rewire, I suspect we'll end up pulling out :neutral:
