Probate (simple)

Sadly my mum died recently, she didn’t leave a will as everything will be left to me! She was single not married and I’m her only child. She didn’t have anything owing on the house worth >£230000. Just one bank account with £3000ish, she did transfer £18000 to me to cover arrangements.... would this be a relatively simple process for me to deal with without a solicitor? Am I right that all I need to do is IHT205 and PA1A? Thank you.

  • You should be able to deal with this without a solicitor. You have identified the right forms to fill in. You should also be able to close the bank account and release the funds from it before you are granted letters of administration, as the amount is well below the limit banks apply to release funds without requiring LOA / probate. 
  • I have completed the Inheritance Tax estate report and the probate application has been completed, both using the online service. It said it may take 2 months to review the estate report and will review your application and issue your grant of probate within 8 weeks. Up to this point it’s been clear what to do, basically I get that I’ve just to wait... but I’ve just received an email from probate registry stating “Your probate application for xxxxx was received and the reference for this case is ‘xxxxxxx’. Send your supporting documents. To avoid any delays in processing your application, send your supporting documents to us by post.” Whist doing the online applications, it never mentioned any supporting documents to send!!! As there is no will should I just send the death certificate? or is the other documents to be sent.... Thank you

    Just a quick update... I received two emails this morning from the probate registry. The first saying “ HMCTS received your documents to support your probate application.” and the second saying “ We approved your probate application. We’ll send you letters of administration in the post. You should receive it within 5 working days. If you sent us the death certificate and any other documents, this will be sent separately by post if you have not received them already. You do not need to let us know when you receive it.“

    I cannot believe this, this has taken less than 12 hours! I’m clearly very happy with this quick process and I’m even more happy after the telephone conversation I had yesterday with the coop probate team offering there service for £4100 to complete the probate!!!!!

    Yes, why pay £4100 for something you can do yourself for £215!
