edf energy

Im a bit of a newbie here so please excuse if this is in the wrong place.
My problem is with edf energy as follows

Ive been with EDF for both gas and electricity for over a year or so but fell behind with the electricty and after many failed attempts to repay a set amount weekly eventually a rep came to the house and asked for either payment there and then or they were going to install a prepay meter.
I didnt have the money there and then so the rep took a meter reading and told me to sit and wait and they would be in touch to arrange when to fit my meter.I waited about 2 weeks and then I received a letter informing me that I had been taken to court (beginning of nov) for a warrant to enter my house to fit the meter.


Now my problem is that EDF are trying to make me pay these court costs when they didnt get in touch to arrange when to fit the meter.
I wrote to them when I got the court letter explaining that I hadnt refused to allow access and that I didnt see why I should pay court fees when, had they wrote to me I would have made sure they could come and fit the meter at a convenient time for everyone.
Anyway I got a reply today saying they did try to contact me via mobile phone and house phone but i must have missed these calls???
Surely they have a duty to put it into writing when they wanted to arrange for me to be in to fit a meter.
What if I didnt have a house/mobile phone anymore?

Is there anything I can do as I dont see why I should pay court fees on top of what I owe?
On top of all this they eventually fitted my meter last friday and told me that my meter key would arrive the next day as theyre sent out via first class post.
Today is Friday, 7 days on and I have no card!!:mad:
I called them earlier and thyere sending me out a new one as the old one "must have gotten lost in the post" and theyre sending me out an engineer as the leccy is going to die anytime now and theres nothign I can do without the keycard thing.

    If they have tried to contact you then theyve done their bit. Why should they mess about writing to you and allowing you to run up more debt, if the meter was fitted without the need for court action then you will only be charged for the initial agents call, which you will pay for.

    You will pay for any action that has taken place. You havent paid, why should EDF pay for it?

    EDF do not control the Post office. Think yourself lucky EDF are not charging you for the engineer to come and supply you with additional power. They could add another £75 (roughly) onto your account for this.


    Some may be aware I do work in revenue recovery for a major supplier, but not EDF ;)

    Stimpo seems to have totally ignored what you wrote, I have dealt with a few collection agency's and their inbreeding and inability to read properly seems to cause the problem in the first place::D

    Yes there is a problem, they verbally agreed to let you know when they would fit the meter. They were negligent and did not do their job properly. I correspond with my electricity company in writing and send everything by special or recorded delivery as I find that talking to them is like talking to a brick wall.

    But they didn't contact you, they verbally promised they would and failed to. I would ask them for a copy of the log of activities on their system to show at what time and date they called you and also a copy of their phone bill showing they made the call. They should have written to you because they've messed up.

    EDF Should pay all costs because you agreed that they could fit the meter and they failed to fulfil their part of the contract by not returning your call.

    EDF quite clearly do not know what they are doing, I am in a dispute with them and their collections dept. sends out useless letters not realising I'm still corresponding with their Customer Liaison Dept. The left hand does not know what the right is doing as usual.:D :p

    Get the evidence and then send go to the small claims court and demand the charges back off EDF.

    Either that or attend court on the application of Warrant to Enter the Premises and explain to the Magistrate you have not attempted to stop them entering the premises.

    There is no legal requirement on energy companies regarding the number of attempts to contact the customer in advance of a disconnection to assess vulnerability or discuss debt. However, the Energy Retail Association, the dedicated trade association for energy suppliers, provided a typical example of the attempts made by energy suppliers to contact customers during the process in its report ‘Protecting Vulnerable Consumers from Disconnection’ (September 2004) as follows:
    · Collections path duration – 5 months
    · 8 attempts to contact through correspondence
    · 2 attempts to contact by telephone
    · 2 attempts to contact by personal visit to the property
    · 1 attempt to contact by visit to court
    · Final attempt to contact at warrant execution
