  • If you need additional arm-twisting, you 'put them on notice' of the damage being caused and that they have been informed of this - following it up in writing. They are then directly liable for this if they don't resolve it.

    PurpParr, you also need to think about what you'll do with the exposed holes - they'll need filling with mortar, ideally, tho' filling them right up with a good outdoor sealant should do.
    Yes I did think about the holes and can get it done properly. I just hope removing the batons isn't going to take half the wall with it since its been there so long.
    It shouldn't hopefully it's just held by mechanical fixings and no adhesive. 
  • So an update. Diddly squat has been done. I have asked for dates when it will be done on numerous occasions now. They have a buyer for the house now so time is of the essence. Shall I tell them I want to access the side of my property to take photos to submit to the legal protection team?

    I would ask them for the name of the solicitor who is doing the conveyancing of the property and when they ask why, tell them that you want to write to them to advise of the potential damage being caused to your property so that they can pass on this concern to the buyers.
    This might push them into doing something.

    Do you have Leg Prot? If so, phone them up. They will advise you, and then hopefully follow up with a letter to your neighb outlining some consequences.

    Time is of the essence here. I would want that off my wall pronto. Can you get a solicitor to send them a letter?

    If something was attached to MY house that shouldn't be, and the owner has been warned, I would be breaking out Mr Sledgehammer from my shed.

    It may have been there long enough to have acquired a legal right to be there. 
    If it was put up and the previous owner acquiesced to it then that may well be the case
  • It's causing damage - damp. End of. The neighb needs to be put on notice of this, and followed up with legal action if required.

    One more approach to your neighb - you ain't going to see them shortly, so you can be quite blunt. Give them 3 days to start sorting it or you WILL take legal action - and they'll have to declare that to the buyer. And if they fail to do so, you need to act.

    (If the neighb 'completes' within 3 days, then the OP will kick themselves - and so will we.)

    YOU NEED TO TAKE ACTION BEFORE IT SELLS, or you are going to have the carpiest of starts with your new neighb.
