Out of interest, assuming the DVLA have been told about the current colour do they also make it obvious in the vehicle registration details that it has been changed? i.e. could a future owner innocently be unaware that it's been resprayed?0

Hi thank you it was a traumatic event as my kids witnessed the fire and it caused a lot off worries for the house and CCTV was fitted after many nights of tears and sleepless nights. This was the first time the car had ever been insured and it's 3rd mot since being imported in early 2000, the car is a rare ra shell only 1000 made and I don't seem to have much about its original spec and I could only find mentioned in forums and little online but it seemed to have had 5 different colours black being one of them but white was the most popular as it was designed for rally drivers. The insurance company had to drop there other points due to them not being able to prove if the parts where original or not. My partner has gave up on his love for cars and this claim I am pushing it hoping he can get something bk from this crappy experience. And if insurance can check DVLA website it states the car is black the car was black so what difference does it being changed really make it was not a specialized paint ect which I would understand. Sorry I am ranting but this whole process is upsetting0

And this will be the second part of your argument to the ombudsman after dealing with why a false declaration was given...
double check the current Q&B system, as mentioned, via Brightside they dont ask for colour nor show the colour that the DVLA have informed them and so arguably they don't care about the colour or if they do then they will have correctly rated based on the colour that was informed to them by the DVLA.
You can see what the DVLA report it as by entering the reg in a website like Free Car Specs by Entering Registration - Rapid Car Check0 -
Sandtree thank you you have been great help I have checked and the car is black on the website. On his part he was stupid to think not declaring due to it not being specialized paint or a custom job so passed it and if calling the insurance they don't ask for the colour. Fingers crossed that the ombudsman can agree. Thank you0

"If you or any of the previous owners have changed or added anything to the car since it was made, please answer yes to this question."That question, and answering 'No' would seem to be the most likely reason for an appeal to the ombudsman to fail. The car had been changed and the person insuring the car was aware of the change of colour. The question didn't ask if any mechanical changes had been made.0

Brightside shuts down MGA Kitsune - Insurance Age
I wonder if the parent co. is trying to 'do the dirty' and come up with bogus reasons to refute claims made against what is in essence a dead company? Presumably, if this gets dragged out for long enough, Kitsune will be dissolved and legal action by former policyholders will no longer be possible. Just a thought. The insurer's position does appear to be weak in the extreme.0 -
