No CCA after 8 monthd

Pra group cannot find the CCA for one of my accounts after 8 months are they ever likely to find it?

    There could be severe delays in offices with what’s going on but 8 months is long, have they said they can’t locate it in their office or it’s in a queue to be looked at?

    They say they cant find it and until they do it is unenforceable

    I would say if 12 months pass it’s unlikely they’ll find it

    Always a chance they’ll find something or a reconstituted copy so just keep an eye out should it happen.

    A reconstituted copy is normally easy to produce, and is compliant with sec 77 CCA.
    The fact they have not sent that suggests to me that they have not been able to locate the original, and don`t hold sufficient information on you to produce a reconstituted version of your agreement.
    After 8 months its possible, but unlikely they will be able to comply.

  • Eight months is a long time, but in the middle of a pandemic, especially if someone will need to inspect non-digital records to locate it I would not count them out yet. When was the original agreement dated? If it was within the last 5-10 years it would be odd they can not locate a digital copy, if it was from 20+ years ago then someone might well need to search through paper archives, which they might not currently be doing, or might only be doing on a limited basis.

    All my debts are from 6 years ago and this is the only one they have not found. All others have been found. I have managed to settle Cabot x 2 debts £1300 each at £400 (so £2600 cost me £800) they have gone off my file. I have 1 default left to drop off in May i cannot wait to be straight and have a normal score it has held me back for so many years

    Just a reminder, your "score" is meaningless and no-one but you ever sees it

    I understand this but if i don't have any credit on my file other than a fully up to date mortgage and no blemishes in the last 6 years i presume i should be re-set back to perfect credit.

    There is no such thing as perfect credit. At the good end lenders want to see regular payments, without over stretching oneself, but their views what good levels of utilisation are, what borrowing ratios to income represent the right balance for their business model etc.

    The best that we can all do is not miss payments and borrow only when needed, but there is no perfect to aspire to.
