Parked Car with no MOT hit by the Lorry
Hey guys,
I would like to seek some advice from you as I am really clueless about what action should I take. My parked car was hit by the lorry on the daylight and as soon as the crash happen, one of my room mate alarmed me about the incident. I quickly went out to check out my car and the damage were on the left hand side of the car - left headlights, indicators, headlamp and nearside body panel were damaged. I approached to the lorry driver and he said he is going to repair all the cost and told me not to worry about it. After exchanging all the details, I came up to my room and checked my car MOT status - my MOT ran out by 10 days. He knew about my car MOT status as he told me that he checked on the GOV website and found out that my MOT has already been expired. He then said he will still repair my car on his friends garage but now, he is saying he will contact his friend and let me know when his friend is available to see my car. I am calling him everyday and he is been saying this for 5 days - there is no any progress on the repairs. I also went garage (as it is still drivable) to see whether I will be able to do MOT on my car. I checked my cars MOT report - it was a fail obviously and the reason for failing the MOT was due to the damaged cause by the lorry, nothing else.
Also, by reviewing the lorry driver details, I figure out the guy is a director of lorry business and the lorry is a company owned.
It is annoying me so much as he is the one who hit my car and said he will fix my car and he is not taking things seriously as he is just pushing back by saying he will contact his friend and let me know.
I don't know what to do, where to look at or whom to contact to as this is my first time experience and would really appreciate if you could give me some advice about this.

Contact your car insurance company & let them deal with it.
Stop all contact with the other party.

I checked my insurance policy online and it says it won't be insured if loss of or damage to the car if it is not covered by a valid Department of Transport test certificate (MOT), if one is needed by law.greyteam1959 said:Contact your car insurance company & let them deal with it.

no vehicle should be parked on the public highway with out mot or tax. if it is insurance is null and void.0

last posts are wrong the correct wording relates to vehicles in a dangerous state , no insurance co can decline a claim if car has no mot , this has been tested in law
PS , if the op had set off for an mot this morning , would he have been driving with no insurance?
gov wording is that you can drive to / from mot without tax and mot and not be prossicuted , prosicution is prob wrong wording as its a £100 fixed penelty for no mot4 -
No MOT does not invalidate your insurance. This has been tested by case law.
In any event, you are not liable for the adding given that your vehicle as parked and was driven into by the lorry. Go onto the askmid website and if you have the registration number of the lorry, you will be able to get details of the insurer. Contact them directly and tell them you want them to sort your claim out.3 -

even so, I dont think the insurance company would be to impressed. and if the police get involved, they will want to know why you had a car on the public highway with no mot. all though admittedly you were not driving the vehicle at the time of the incident, in your defence.0

Well it doesn’t matter if the OP’s insurer is impressed or not. Liability for the accident lays with the driver of the lorry given that it collided with a stationary object.
