Redundancy Confirmed - Negotiation Points

Hi folks,
Had my redundancy confirmed verbally last week and should get it in writing soon and a formal meeting to confirm also. In terms of any negotiation points now to maximise my benefit, what are the points I should try negotiating on? BTW, I have a new job to go to and they would be happy for me to start in a month to 6 weeks and notice period in current role is 3 months.
As far as I can tell:
- Actual redundancy payment - I suspect i'm unlikely to get much more than statutory but wonder if this might be negotiable?
- Garden leave and/or PILON - if there's no financial benefit then I guess PILON is better so I can have a month off and then start the new role as soon as they want me?
- Rather than PILON - is it possible to mutually agree to shorten the notice period (and therefore their liability for paying me, in return for a larger redundancy settlement (which therefore reduces my tax))?
- Not bothered about laptop, don't have a work phone or car so nothing to negotiate there.

Anything else I should think to ask about / negotiate on?

    If your employers know you have a job to go to, you are actually in a very weak position. They can easily withdraw the redundancy but agree to your early release, thus saving themselves thousands. Google "Redundancy Counter Notice" for info on making sure you get your redundancy. 
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    They don't know about the other job (yet. In sure references will be requested in the next week or two)

    Can they withdraw the redundancy once it's been confirmed if they find out I've got a job to go to?

    I presume with a counter notice, i.e leaving sooner, I'd lose pay on the reduced notice. Would rather not do that so PILON is highly preferable. I don't think they'll want me hanging around either to be honest.

    They can withdraw the redundancy notice at any time prior to you actually leaving. That is why you need to issue a counter notice. A counter notice has no bearing on your leaving date, it just means they cannot withdraw the redundancy notice. If you want to leave early, why would they agree to PILON?  You go early by mutual arrangement, they pay you for the days you worked, there's no incentive for them to pay you any more

    Apologies if I'm misunderstanding you lincroft, but reading online seems to suggest that my employer cannot unilaterally withdraw the redundancy notice unless they offer me my old role back or a suitable alternative, which they won't.

    Can my employer withdraw my notice of redundancy?
    Once your employer has given you notice of redundancy, and you are no longer just ‘at risk’, then your employer cannot change its mind and withdraw that notice without your consent.

  • Just to add with regards PILON, they don't want me there, I don't want to be there so it seems a choice between garden leave and PILON. There is little difference or benefit for them either way as far as I can tell so, leaving on good terms, I expect them to be open to my preference.

    Redundancy should only occur if a job or role becomes redundant. If it transpires that there is still a need for that job/role, there should be no redundancy, so if a redundancy notice was so issued it should be withdrawn. An unscrupulous employer with an employee in your situation could withdraw the redundancy notice, hence the need for a counter notice. It is basically to protect your right to redundancy pay.

    Garden leave means you are still in their employ and could be recalled back to work at any time, so PILON would be preferable.

    As I said in my first post, if they find out about the new employment, then your position is weak. You have to make sure they don't find out and take every opportunity to safeguard your rights

    Request PILON and have a month off.  Many employers are more than happy to terminate contracts early. Removes a potentially disruptive influence from the office. As far as they are concerned they would expect you to be seeking new employment in any event.
