  • They didn't own their house,  she was renting,  however,  there would have been death in service payment and the £600 was spends for a holiday,  with hindsight I wish I had never lent it to her but I was never expecting not to get it back.  No the son lives in different county

Did she have any other debts?

Her family may believe that her estate is insolvent and may choose not to administer it.

How do you know about the death in service payout, do you work for the same employer?  Do you know how the scheme works?  ?X salary?
How's it going, AKA, Nutwatch? - 12 month spends to date = 2.60% of current retirement "pot" (as at end May 2025)
  • I worked in same place,  the death in service would have been approx 3 times salary so I would say 90k

  • I don't know about other debts to be honest..... I couldn't sleep at night knowing that My mum owed anyone when she died,  Myself and My Sister put notices in paper etc,  but we knew Mum was insured and owed no-one
  • The family have been aware of this for 15 months,  and still no repayment,  just words of I am sorting it out etc etc,  until the police rang to tell me off for asking.

Another thing to bear in mind in these stressful times is the "executors year".

Basically, they have a year to administer the estate.   So it maybe that you will get paid, eventually, but not necessarily quickly.

Write the letter, as detailed up thread, and wait.    Don't pursue...yet.

Is the DiS written with an expression of wish, with a named beneficiary.   If so it "may" fall outside the estate?

If you're in the same scheme you could check this.  And make sure yours is in order at the same time.

The family don't owe you any money.
Calm, factual letter to the Executor of the estate, including evidence of the debt. It should then get paid off as part of winding up the estate.

  • how do I find the executor?  Any ideas.....

    Sorry crossed post.

15 months should be plenty of time to deal.
