  • Sent the Court an email and got a reply within 5 minutes! 

    Court fee paid and their WS re-filed - therefore hearing goes ahead for mid January.

    Time now to prepare my Supplementary WS to highlight the issue I have with the lease (I interpret it as expired) and that the land is council owned and controlled therefore PoFA does not apply.
  • I'm just about to submit my Supplemental WS adding points noted earlier this month.

    Maybe a stupid question, but here goes, In reference to my paginated bundle of documents for the supplemental WS, do I commence with a new numbering sequence or just a follow on from my original WS?

    As it is a supplemental, I would start again.

    As you have been asked for a 'paginated bundle' I would suggest that you continue with the numbering system from where you left off.

    In other words, in your bundle there should only be one page numbered one.
    And for example, if  your current bundle ends at page 23, then a Supplemental Witness Statement should start with page 24.

    Just my opinion though.

    I think the poster was more referring to the point/para numbers rather than page numbers, but I'd agree that continuing the numbering system in both respects would make sense in terms of the trial bundle. :)

    Thanks for the advice -unfortunately I'd already pressed 'send' before seeing these replies and restarted the page numbers - the supplemental WS was on 2 pages anyway and clearly stated that it was supplemental to my original WS which was submitted last July - hopefully it won't impact the judge's ability to see what I was saying - expired lease that basically killed the attached  management agreement and therefore negated landowner authority.

    I finally have my court hearing next week (2.5 hours reserved including 0.5 hours reading time).

    BWL delivered me a full copy of their 'Trial Bundle' all in lever arch file including tabs for my own defence & witness statement - probably an attempt by them to intimidate me by showing me how organised they are (won't work!) - fully expect a call from them next offering to settle for a lesser amount in advance of the hearing (won't work either).

    They've now bumped up their claim by another £52 since their original MCOL. So the original £113.94 has now had the usual (illegal) £60 added, £25 court fee, Legal representative costs of £50 and now another £52. 

    I'm quietly confident of seeing them off, but still find the experience annoying and somewhat nerve wracking - any advice and guidance on what to expect with the court process & etiquette of course will be greatly appreciated.
