Private company imposing restrictions and fines on a public road

My daughter lives on a large estate where all the roads are adopted by the local authority. There is a problem about street parking but as most houses have only a single drive many owners have to park on the street as do visitors. There is a management company which looks after grass verges etc but not the highway. The management company is now proposing to appoint a private company to put up notices and collect parking fines for cars without a permit . Can they do this and if they issue a ticket are any fines enforceable? This is not the Council and as far as I’m aware no yellow lines are on the road and the Council hasn’t put any notices up on street posts or anywhere else. I need to pass this information back to my daughter so can anyone give me a definitive reply, quoting case law or legislation if possible ?

IMO it is most unlikely that this is not a private road. Perhaps OP has not fully researched the matter.You never know how far you can go until you go too far.1

its possibly an ALMO like the WING cases were and maybe we do not have enough information ?think Islington council, WING parking and ALMO status1

The key question to answer is ... are the roads actually maintained at the public expense (i.e. adopted by the council)? The only way to know for sure is to contact the council and ask. In the meantime she should check her title deeds to see if a) it mentions the roads and b) mentions anything about parking.Jenni x3
