That letter is a template and means NOTHING. Don't respond and don't offer money, it won't get them off your back.they've again split the two claims, despite me pointing that out in my defence and inviting the court to strike out their claim - I’m wondering if there’s any way to chase this up with the courts or if I just have to wait for the hearing for this? No! You will be banging on about Henderson v Henderson in EVERY email and every submission from now on, until the court consolidate the claims into one hearing.
Now that I've made that clear, don't go forgetting to repeat it when you email back the DQ x 2 shortly. I'd download one as then you know you've done it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok so no need to wait for DQ to arrive from court, just download and do one, thank you
I've (perhaps foolishly) been following the mcol and hoping they will run out of time
will be sure to mention Henderson vs Henderson in each email going forward, thank you so much for your continued help and support!2 -
Check your MCOL claim history first , see if the defence was logged and if the CCBC have posted the n180 yet
Then download the n180 and fill it in
Email it to the ccbcaq email address after they say it's been posted , twice
Ps , it's not a court , it's a civil servants office for the government , so if you mean CCBC , say so , it's fewer letters
You will nominate your local court , the first court involvement , in your DQ3 -

Apologies for the confusion, yes everything is going via CCBC at Present. MCOL hasn't been updated beyond my defence being received, so I should wait for this before sending?
The MCOL hasn't been updated to say that the claimant wishes to proceed so was hoping it may just lapse that way but I suspect they're just being slow about updating it.
And when you say email it twice, do you mean once per claim? Or twice per claim?
Thank you for your help0 -
Twice because you have 2 claims, and I already advised you to download one. They are proceeding.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OK thank you
Apologies to ask the same Q, there seems to be various opinions about whether to submit now or wait for CCBC to send one, and with MCOL not being updated, I'm still hopeful that it may not proceed. I realise that may be overly optimistic
And if it does, I don't want things to go any faster than they have to, I have quite a lot on that I need to finish before I have the headspace to dedicate to the next steps of this.
Is there any benefit to being heard at one court vs another? I have central London CC and Romford CC pretty much equidistant...0 -
I'm still hopeful that it may not proceed.
It will and the template letter is surely headed 'intention to proceed'...(we've seen it far too often).
They ARE proceeding, they always do. Discontinuations are common but they happen much later, when you have called their bluff with a decent WS and evidence in a few months. Is there any benefit to being heard at one court vs another? I have central London CC and Romford CC pretty much equidistant...I'd go for Central London as long as they are listed as hearing County Court cases, partly because the Recorder Cohen QC decision I mention here for WS stage looks to have emanated from that same court circuit:
https://forums.moneysavingexpert.com/discussion/6279348/witness-statements-2-transcript-exhibits-re-parking-firms-falsely-added-contractual-costs/p1
So your WS that includes that transcript should go down well with the Judges to cement its application to parking cases with an almost exact-match clause about adding costs 'on the indemnity basis'.

As above
There is no confusion as to when to email the completed DQ , it's either after MCOL website has been updated and a postal DQ sent , or after it arrives in the post !! Not before !!
You are being told to download it and fill 2 in , to be ready to go forward at the correct time on both claims , 2 claims requires 2 defences and 2 DQ submissions , followed by 2 witness statement bundles , double bubble2 -
Thank you all for all your help and patience so far, I promise I'm not this thick IRL!
I've done DQ x2 and will submit those later today via email. The other party have used my email for service purposes so I hope this will be fine, without me needing to post any of them.
Is it worth adding the estoppel paragraphs and henderson vs henderson to the DQ emails I will send? Or is this unlikely to be taken notice of by the CCBC administration?0
