Private Parking Solutions not providing POPLA

Hi everyone, long time browser and have managed to secure some great money saving tips over the years at MSE and get some unfair parking "invoices" cancelled due to all the help provided.

The situation I am in now is a bit tricky and I don't know how to proceed from here.

So essentially Private Parking Solutions gave a parking "ticket" as they say on the windscreen, with an observation time of 2 minutes before it was applied on to the windscreen. The vehicle is leased so essentially the owner/registered keeper is the lessee in the situation:



In this case, I followed the standard BPA template for the appeal and applied as behalf of the registered keeper and appealed on the 28th day. In this case I was expecting they would reject the appeal as it was not actually sent in by the registered keeper and that they would provide a POPLA code:



They have responded back stating that the registered keeper will need to apply before they can consider any appeal and haven't given any POPLA code. This is their response:


A bit baffled by their response, I am not sure how to proceed from here if I am being honest. What would the best response be in this instance? I tried to search for other users answers but couldn't find something similar so I thought I would open this thread.

    They are correct , you followed the wrong advice , due to being a lessee and not the RK

    Scroll further down that first post in the newbies FAQ sticky thread to the Edna basher advice at the bottom , for hirers , lessees and company vehicles

    Meaning the RK is responsible until the RK names the lessee under POFA

    No, the NTK would have been sent to the lease firm by now because they are being pedantic and saying they hadn't got an appeal from the driver so could write to the keeper after 29 days.   The reason we tell people to appeal as lessee/hirer early is to stop letters going to the lease firm, in case they pay it, so you did it right but PPS(L) are playing the long game.  Technically they are right.   We only rarely see this.

    So, contact the lease firm this week because time will be running out for them to transfer liability (not that it really runs out until court but PPCs pretend it does).  I assume a NTK was sent to them in mid January and you need to find out what the lase firm have done about it. What you want uis for them to fill in the Transfer of Liability slip so that you get sent your own NTH. Them you can appeal as lessee.
