Do I need a party wall agreement?

Hi
I am planning on building an extension on my house. As part of the works I will remove an existing fence and build a wall. The wall won’t be built on the boundary line instead it will be a few inches away so the wall is completely on my property including the foundations. Do I need a party wall agreement with my neighbours to build this wall?

Does the neighbour have any buildings to the side of your proposed extension?

I was under the impression the PWA could only apply here if the neighbour had a building/structure to the side, i.e. running parallel with your proposed side wall.

I was wrong. The distances are to be seen in more in a radius kind of way. That said if ‘any’ part of your excavations are within 3/6m of ‘any’ part of your neighbours’ foundations, the PWA could apply. Usually where the new wall connects to or extends off/away from the original real wall means you’d need to check your requirements under the PWA.0
