Redundancy & Furlough

Hi All.
My company has begun the redundancy consultation on my role, and as I am the only one in this job role I know what way it is going!
During my first consultation meeting, I requested to my MD I be left on furlough until the scheme ends, and then if redundancy is still the only option, begin the notice period from then.
He has taken it back to the company lawyers who advised him that because the consultation period has begun this is not possible.
Now I am sure this is incorrect, as I am sure that I have seen Martin Lewis mention that even if the employee is in the notice period the employer could withdraw the notice and place the employee back on furlough.
Could anyone confirm for me please?
thanks a lot

In theory they can do. But the scheme costs your employer. So if they have decided that the job is going to go anyway, they would not want to carry on throwing money down the drain. The longer they keep you on the more it will cost them in the long run.

Until the furlough scheme ends could be both an open ended and expensive commitment for the employer.0
