BW claim going to county court

PARKING_2 said:Hello Everybody,
Just thought I would post a quick update. The case was heard today in Worcester County Court and the (very friendly) Judge found the case in my favour. The claim was stuck out and was I was allowed my fixed witness costs. Advice to anyone would be to pursue claims and don't get scared by the threatening letters the parking companies send. One interesting point the C solicitor made was that my witness statement looked like a copied and pasted witness statement offline. When I explained that I had no legal knowledge and had to adapt one that I had found online, the judge was more than happy!
Thanks everyone for your support!
Same old wheeze "copied from the internet" ...... BWL have their own copy and paste keyboard warriors ..... all their statements are always the same ???4 -
Well done on your win.4

Good stuff, excellent win. 🥂Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It demonstrates that when it comes to the crunch, their 'evidence' is often flaky.
I had a case a few weeks ago, where the D had 13 tickets for parking on the private roadway instead of his allocated space. It didn't look too hopeful, until the C's bundle arrived, and all but one of the photos had been taken in the dark, such that all you could see was the number plate, you couldn't tell what car it was, where it was parked, or any signage visible.
The Judge agreed, and only awarded the claim on 1 ticket (as well as chucking out the £60 add-on), so he ended up paying around £200 instead of the £2,400+ they were claiming.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.6 -
