Warranty on discounted product

Hi,
we bought treadmill online and it got delivered slightly damaged. It has a slight dent in the body, but apart from this it is fully working. We reported it to the seller and they offered us a 25% discount if we want to keep. If we agree, does it affect any future warranty claims if the treadmill breaks down with any other fault. I would think it doesn't affect the warranty, but can't find anything in the CRA about such a case.

  • There won't be anything in the CRA regarding this because the CRA doesn't cover warranties, only your statutory rights and a warranty is in addition to these rights.
    Because of this, a retailer or manufacturer is legally entitled to say that if you accept their offer of a 25% refund, no warranty will be provided but if they do this, it doesn't affect your legal CRA rights.
    I can't imagine they would do this but it might be worth getting an assurance in writing that the warranty will still be valid should you take them up on their offer.

    A few years ago I had a similar situation with a Samsung washing machine that came with a 5 year warranty and a large dent on the back.  I contacted Samsung directly to check if it would affect my warranty and they asked for photographs.  They then emailed me back to say that it would not affect warranty.  We are well outside the warranty period now.

    I don't care about your first world problems; I have enough of my own!

    Would this be the seller? I'm not so fluent with this legal speech ;-) I ask the seller now to clarify the warranty status.

    The only way to know is to check any warranty documentation.
    In most cases, it's the manufacturer who provides the warranty but occasionally it can be the seller.
    What make is the treadmill?

    Seller / Vendor   = Consumer Rights Act  ,the law .

    Not part of CRA .
    Manufacturer usually offers a warranty subject to any terms they want .
    A seller may also provide a warranty , again not the law and any terms they want .

    The seller is usually the retailer.  Think John Lewis selling you the Runfaster treadmill.

    The warranty provider is usually the manufacturer.  In this case it is Runfaster.

    Sometimes they can be one and the same.  John Lewis own brand treadmill.

    Warranty = subject to the terms and conditions of that warranty.
    Consumer Rights = legislation.

    Many years ago I bought a tumble dryer with a small dent in the side, It turned into a nightmare as there was a circuit board attached in the same area.

    It's Bluefin Fitness. The seller is also the manufacturer.

    In that case I would just keep a hold of the correspondence about the damage. They'd look pretty stupid trying to refuse a warranty claim on those grounds.
