No fault accident to my parked car no tax

Hi, my car was hit parked outside my house by a council vehicle, the driver admitted fault and gave details but my car tax ran out on the 21st December and due to covid and Christmas I hadn't been able to get it booked in till the next month but I didn't need to use it so it was just sat, meaning it wasn't taxed at the time of the accident, will their insurance still pay out? Thank you

My own tax runs out at the end of January.
I think this one is in the hands of the insurance companies. I have heard mixed stories about whether or not such an accident will result in payment.I don't care about your first world problems; I have enough of my own!4 -
As it was their vehicle that hit yours then their insurance will have to pay out.
If it was YOU that had hit someone then your insurance might not pay out, but this isn't the case.
BUT...parked on the road with no tax and hit by a council vehicle. I would imagine that this will be reported and a fine for no tax. If shielding I imagine you can defend this.Should've = Should HAVE (not 'of')

Lack of tax is going to make no difference at all; tax doesnt transfer with ownership and so it doesnt even impact settlements on a total loss.
If it was MOT then that could be slightly more complex but if you deal directly with the third party insurers then its impact is only on the car valuation and so would make a total loss slightly more likely and a lower settlement if it is a total loss.0 -
As you are required to tell your own insurer, read their small print about the requirement to keep your vehicle taxed and MOT current.
They may ask for details of what and where it happened even though you are not at fault, as may the insurers of the vehicle that hit your car.
If they find out the vehicle wasn't taxed and on a public road they may get a little more interested.0 -
