Its always caused me stress even more now knowing i was lied to over 5 years ago when they gave me this ccj. The damage a CCJ does to your credit report is immense and from that point i've had to deal with the fact that i could not work on customers accounts as those customers deemed me untrustworthy. After the bankruptcy ended i thought then another three years it will be on my report but no I get given a CCJ which I had put as part of my bankruptcy. I started throwing up at work first of all thought it was a bug and then it kept happening where a headache would start and then the feeling of wanting to be sick. Then i would be sick repeatedly this i realised was migraines brought on by the stress of being in debt. My company didnt understand they told me to work through it as no one else knew the job. I have a video of me at work throwing up into the sink and then you see my right hand going in and out of the sink where im pushing the sick down the plug hole. Do you have any idea the stress debt can do your body from your first words what stress i dont think you do. The bankruptcy was supposed to end one chapter and start a new one not for a company to ignore and give me a CCJ.
Not sure why you would video it at the time, unless you needed to prove something.

Of course bankruptcy and CCJ's can cause stress, that was not the point I was making. By saying what stress I was meaning that it is only after years when the solicitors have realised and processing the set aside for you that you now want compensation for stress caused, and not at anytime before.
If it was causing stress before hand did you not think of getting advice. If you believed the CCJ to be invalid because you were bankrupt, you could have got advice and applied for the set aside yourself.

If you are considering legal action, especially against a solicitor, then I hope you have deep pockets.
These type of cases can be a money pit, as obviously they will have legal representation, and so must you.
You need to consider the cost, and time involved prosecuting such a case, and the fact you may lose, and have to pay costs.
Take legal advice first before you do anything.
Legal Beagles (Google is your friend) is a good place to start.

You can make a complaint via the solicitors regulation authority.
I'm not sure what evidence he has that he was lied to though.

I would imagine that it would also be extremely difficult to prove any sort of causal link between a CCJ several years ago (or indeed any time) and being unwell at work.
All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.

Depends if he was lied to. I may be wrong, but it sounds like he got the CCJ, phoned up, and believes he was told it was valid as it was a joint debt, paid it off. After some years when it was highlighted the solicitors are taking remedial action to set aside.

Does he have evidence, otherwise the solicitor could say they were unaware of the bankruptcy and applied for the set aside once they were told.
