Ok, that makes sense!nosferatu1001 said:You send the draft order as a docx so it can be edited
Thanks a lot guys. I have just paid the fees and will send it in due course. I let you know of the outcome and I might need some more help further down the line.1 -
I would advise you keep reading set aside threads so you know what can happen on an actual hearing. The more prep you do, the better
You need to make sure you can explain your reasons for set aside succinctly if asked, and have rehearsed as much as you can. This is your one shot, so do everything you can to get it right.
We see very few refusals, and the couple we have seen have been poorly explained it seems. Dont let yourself be number three!

Good advice, I'll go as well prepared as I can. It's only one shot that I have, but thanks to everyone here I can have way more chances of not being the third!nosferatu1001 said:I would advise you keep reading set aside threads so you know what can happen on an actual hearing. So if you have changed the Claimant to read 'FIRST PARKING LLP' it seems to me you have leapt nicely over this first hurdle!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello, just for an update, just have received the set aside hearing for the 3rd of June at Portsmouth County Court. Any further advise other than the ones found on other threads?
thanks!!0 -
Not unless you have any specific quesitons!
Preparation is key. Have bullet points.2 -
Hello,
The hearing for the set aside has been successful and now I have to file a defence by the 18th of June.
I am going to use my draft defence, even how the judge did not order to solely use that, but I have to amend it to make it a formal defence I guess.
I also guess I have to attach a draft order to it as well?
Unfortunately the judge ruled out the costs and I will loose my set aside fees, but at least I can defend myself and get it off my record!
Thanks to all!1 -
Just use the standard defence template and add your points to paragraphs 2 & 3. Why do you think you need a draft order, surely that was for the set-aside hearing?1

Hello guys. Just to let you know that the hearing for this case was meant to happen tomorrow and I have just received notification from the Claimant that their client has instructed to stop all court proceedings and file the case. They waited til the last day but that was another win! Thanks to everyone that helped!3
