    Although it has now become commonplace to believe that any mistake is a criminal act and must be punished, the law doesn't actually back that up.

    I presume three years ago when the VM salesman targeted an elderly person's estate I am aware of and performed 'hard search credit checks' on several tenants without their permission that was several mistakes and misunderstandings in one day as well was it?
    I don't know. Was it?

    You appear to have a!l the details of that case and I have none, so you're going to have to make your own assessment, rather than handing it off to others.

    But either way, things that may or may not have happened to people who aren't you, in no way changes the original point.

    OP - it sounds like, albeit being greatly stressed by the situation - you have a handle on it and are taking the appopriate action.

    It's a huge waste of your time and you'll have to wait upto 28 days for the situation to be resolved.

    The recording of a credit search footprint on your credit file without your consent, is a breach of data protection, and Virgin have an obligation under the ICO guidelines to correct this within 28 days of you notifying them of it.

    Make sure you write to them, you'll need proof of having raised a formal request to have the footprint removed, if it is still there in 28 days and you feel the need to escalate this to the ICO.

    Virgin Mobile conducted a search without your consent - their lawful obligations extend to correcting this error within 28 days of you bringing it to their attention. 

    It isn't a criminal or civil offence; but it is a matter that can be brought to the attention of the regulator (ICO) should it take more than 28 days to resolve.
