Accommodation with job and now redundant due to COVID

My partner’s son and daughter in law manage a pub and they live in the premises above the pub. They have been  on Furlough but were made redundant on 08 January 2021 and given 4 weeks to notice to leave the pub. Neither have a contract and they pay their own utility bills, broadband etc Do they have the  rights and protection of a short hold tenant  i.e need 6 months notice to be evicted and what are their rights?  They have approached the council but they cannot help. They have a 10 year old son and as neither have jobs, finding a private rental will be nearly impossible. They are both very stressed as they have nowhere to go.

    They need to clarify what the council mean by “cannot help.”
    My guess would be that the council cannot help at the moment because they still have accommodation. What would usually happen is that they would be evicted then present at the council as homeless. As they have a child, the council would have to offer temporary accommodation but depending on where they live it could be a B&B or in another area. 
    I would advise them to phone Shelter about their specific circumstances. 
    All shall be well, and all shall be well, and all manner of things shall be well.

  • If its tied accommodation then the accommodation ends when the job does. This is really something they should have insisted on a written contract for so they knew the notice period for leaving beforehand. Are they in a position to rent another property right now?

    They stay there until the employer gets a court order and that will not happen tomorrow.  When the order is issued the council will give them housing of a sort but will do nothing until then.

    This is a long shot, but what will happen to the pub now?  If the pub manager has been made redundant, does that mean the pub is closed for good (at least as far as the current owner / tenant is concerned)?  Is the building now for sale / to let?
    Could the OP's son & daughter-in-law offer to stay in the flat as live in security for the pub while it is not able to open?

    they do not have leave when asked. They can wait until evicted by the court. Court proceedings have been suspended for the duration of the lock down.

    Exactly how is this accommodation (the flat above the pub) arranged and could it be interpreted as an integral part of the pub?
    Is the access to the flat via the pub, or a private access from the street?
    Could this make any difference to the rules that apply?  If the property is half commercial and the flat cannot be wholly separated from the pub?

    If the pub is permanently closing, at least for the foreseeable future, speak to the brewery direct and ask if they can remain there as security, naturally with no payment either way.

    Then get them to apply to every supermarket in the area, as many are still recruiting at the moment. A more relevant job to their skills can be found when they are working in a job already, and a willingness to do just about any job will certainly score a lot of points with many employers in the near future.

    If they are both working with no rent (hopefully through both of the above), then they should be able to save quite quickly for another property when this is needed.
