Do staff in takeaways have to wear masks?

Hi.

I have had a quick look but can't see any hard and fast rules on this - do staff in takeaways have to wear masks when preparing and handing over food, please?

Comments

  • Yes they do -
By law, staff and customers of venues that provide food and drink will be required to wear a face covering, unless they have an exemption.'
You can find the guidance here -https://www.gov.uk/guidance/working-safely-during-coronavirus-covid-19/restaurants-offering-takeaway-or-delivery#takeaways-6-1
    Section 6.2

Staff are exempt from the Covid mask wearing legislation (In England, Scots law might be different)

However they might have to wear them under H&S legislation if the business' risk assessment decides they do

    That legislation has been amended:
"(2A) The exceptions from the requirement to wear a face covering provided in regulation 3(2)(b) or (c) do not apply to any person who, when acting in the course of their employment or providing services under arrangements made with the person responsible for the relevant place, is in any part of a relevant place listed in Schedule 3 which is open to the public, and comes or likely to come within close contact of any member of the public."

    Schedule 3 is at https://www.legislation.gov.uk/uksi/2020/791/schedule/3

So, if I've got it right, the counter staff will have to wear one. Kitchen staff will still be a maybe/maybe not depending on risk assessment

    I believe that is correct.
