Stick to the point - you moved out, knew you would have to pay until a new tenant moved in. This happened on 30th November and no refund, indeed no contact has been forthcoming.
Then write to the agent, informing them that you know a replacement tenant moved in on 30th November and you are therefore requesting full and immediate settlement of the difference in the money you have paid and the money you actually owe. If this is not forthcoming within 7 days, you will be formally submitting court paperwork, of which you enclose a copy. They will then be liable for your court costs as well as the sum of whatever it is they owe you.
They're expecting to to roll over and accept it. Show them you won't
Sorry to bother you again.Do you know how to print off the claims website?0 -
Here is my letter in full
Dear Sir/Madam
As you are aware due to personal reasons I left university and my accomodation on November 16th 2007.On November 30th 2007 I was contacted by Stephanie to inform me nobody was going to move in and I would be liable for the full year until a new tenant was found. I found out via an ex flatmate on December 3rd 2007 that a new tenant moved in to replace me in room BG15B on November 30th 2007. No call was made to inform me of this and numerous attempts by myself to contact you have been ignored.Despite a new tenant moving in I was charged for the full term. The contract clearly states once a new tenant is found I may be released from my contract and refunded also according to the terms of the Landlord and Tenancy agreement of 1954 I will be entitled to a refund of my overpayment to Unite in respect of my now annulled rental agreement since November 30th 2007. Given the date the new tenant moved in I overpaid you the sum of £696.40. I expect this to be paid back into my account within 7 days(17th December). If I do not receive the full sum within the 7 days I will take Unite to court for the full amount plus interest and court fees from the 30th November 2007. I wil file a claim against the company via Her Majestys court service and Money claims direct if I am not refunded.I am very upset and angry at this affair and feel I must point out that according to the Landlord and Tenant act of 1954 the company faces the prospect of being blacklisted when you are found to be in violation of the law and the terms of my contract.I await your reply0 -

I'd leave it blank I think for solicitors fees. It's pretty cut and dry, I'd hopeI've not done it before but I'm just using a common sense approach. Your tenancy agreement is quite clear and the clause is certainly part of a standard agreement so they don't really have an argument. I think they will probably pay up when they ge the letter - are just hoping you won't put up a fight and are unaware of your rights.
As for printing, I hope this makes sense, LOL!

You're all being a bit nice to me but I was hoping someone with more experience of the process would have answered. I'm only going on what I've already read on here a few times!
Thanks so much for the compliments. I do get into my fair share of scraps thoughIf people think I've helped them then that's really made my day. Someone's actually nominated me for post of the month this month
