What are my rights when a company refuses to accept a return?

Hi,
I bought some metal wall shelves for my son's bedroom but when we came to hang them we found pipework in the wall and they wouldn't fit anywhere else so we arranged to return them. I photographed the shelves carefully before I returned them as the company said any goods used or damaged in transit would be refused. I repacked them and added extra packaging and dispatched them with UPS. 
The company has now been in touch and shown me a photo of the shelves with two of the shelves with damaged corners. They blame me for "not positioning the shelves correctly in the box". The company is located in France.
I asked them to resend the shelves back to me and I would pay the shipping costs. Otherwise I would lose all the money I originally paid and have no shelves either. I thought I might be able to sell them or give them away.
I have effectively lost £138
What are my rights?

    Your rights are French rights, but if you booked and paid for the return and they are damaged, then can you claim compensation from the shipping company? Do you have photos of the box to show the damage sustained to the box, rather than the shelves?

    As above not covered by UK law . Pursue UPS for damage . Did you insure with UPS .
    You could try looking up French Consumer/ Sales laws /could be a link on the vendors web site .

  • You need to launch a claim with UPS and let them handle it - it's not the seller's fault if the items arrived back with them damaged.
