I had a partner who gifted me some money when he sold his house and moved in with me. He made no further contribution to the bills and I even paid for two holidays. I knew it wasn’t working out so asked him not to sell his house but he went ahead. The money just appeared in my account one day .
He was very careless and also brought with him a destructive puppy who proceeded to chew hundreds of pound worth of my spectacles , furniture ( and me ) .
Eventually I’d had enough and asked him to leave and to encourage him said I would return the money which he said he wanted in cash or into a new account as he was claiming benefits now .

He has now died . I had promised him I would pay for his funeral which I have done . There is a balance in my favour but I feel as if that is mine . He had said that if anything happened to him to keep any outstanding monies . The only fly in the ointment is a few months back I sent him an email telling him how much I “ owed “ him . I carelessly used those words. In reality I was going to reduce the figure for one years free board , no rent etc plus damage him and his dog did to my house .
The executors are making waves about the outstanding money ( cousins - he had no children ) Does anyone know if I am legally obliged to pay more than the funeral .There is enough money in his estate to pay his debts .

Impossible to know from what you've said. What sort of figures are we talking about?Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!0

It seems that you have formally acknowledged a debt - the exors are within their rights ( and indeed it is their legal obligation) to seek repayment.

The only way that I can see you arguing that the money shouldn't be repaid is if you have some sort of written communication from him saying that you should keep any outstanding monies.0

Work out what you think you are owned regarding the 12 months board ,damage to furniture etc, deduct this from what is owed to the estate and offer to make this cash payment to the executors explaining why you have made deductions ,you never know they might accept this to save going legal.0
