I paid the Daily Mail for an online subscription...with a free gift,,,err except I didn't get one :(

Hi,
About 8-9 months ago I paid the Daily mail for an online subscription, they were offering a free Kindle Fire with this.
I waited 3-4 months and got nothing, so I rang them in September and was promised it would arrive soon.
I then left it until a few days ago when I rang them again and asked where it was.
Same answer from one person, their supervisor, and their customer support staff.
Which was, "sorry we don't have any left ,and we sent you an email you should have used a few months ago"
I received no such email, and if I had I would certainly have answered it instead of ringing them.
Any tips for where to go next ?
I am not letting them get away with this, they made the offer, I paid for the subscription and contacted them twice to find out where my free gift was.

    I'd pay more than RRP for a kindle that didn't come with a Daily Mail subscription...

    Go back to the terms and conditions of the offer and check them.  I suspect there is a "subject to availability" clause in there somewhere, but post the terms on here and people can see what you're entitled to.

    I think you should vote with your feet: cancel the Daily Mail subscription with immediate effect and never read the thing again.

    I wouldn't cancel, there might be another run on toilet paper.

    Having such a clause doesn't automatically remove all liabilities from the businesses concerned.

    Code rule 8.11 states that if an advertiser has made a reasonable estimate, and expects to meet the demand but cannot due to an unexpectedly high response, they must ensure timely communication with consumers and in the case of detriment, offer a refund or reasonable substitute.

    Don’t rely on “subject to availability”

    Merely including a statement along the lines of “subject to availability” is not enough to relieve promoters of their obligations to avoid disappointing participants (Rule 8.9) as the rulings referred to above often show.

    I am sorry about the issues that you have encountered with regard to your subscription with the Amazon tablet incentive.
    As previously explained the terms & conditions stated that the code supplied to obtain the tablet had to be redeem by 31 October 2020, as the codes expired on that date.  I understand that you have not received the email that was sent to you enclosing the code.
    However, as a gesture of goodwill I am providing you with an alternative Amazon code to the value of £60 in lieu of the £50 tablet.  You can purchase a tablet if you wish, although it can be used to purchase whatever you like.

    This code expires on 28 February 2021.
