in Credit cards
Hi
Not sure if this is right forum for this please move if not. We booked to go and see relatives in Spain last year in March with Ryanair. The FCO advice was not to travel to Spain as they were in lockdown but the outgoing flight did go and a few days later our return flight was cancelled by Ryanair. I put in a claim on my credit card for the outgoing flight and car parking as we obviously could not go to country that was in lockdown and FCO advised against. Tesco bank have refused this claim saying they did not breach their t and c's. Surely ignoring government advice overrides terms and conditions. ? How do I stand here. Any help of feedback please

Your bank is correct. S.75 means Tesco Bank is jointly liable for breach of contract. Ryanair did not breach the contract if you bought a flight and car parking and they were available to you. FCO 'advice' doesn't change that contract. It sounds like this is a matter for your travel insurer.

You still should of got ur money back under S75 !!Contact Tesco bank again and re raise the claim/ chargeback for not getting services
hope this helps u x0 -
Unfortunately, inaccurate advice doesn't help anybody, however well-meaning - the previous poster was correct that there are no grounds for a s75 claim here as there was no breach of contract by the supplier, and anyone suggesting chargeback instead of s75 needs to be aware that such claims need to be raised within 120 days, so the opportunity to claim via that for events ten months ago has long since timed out. Likewise the guidance in the other post to claim from travel insurance is spot on too....blowy_lil said:You still should of got ur money back under S75 !!Contact Tesco bank again and re raise the claim/ chargeback for not getting services

Ryanair have done what they were paid to do by OP (fly from UK to Spain on a certain date at a certain time between certain airports). That OP chose not to use this is not Ryanair's problem, and not Tesco Bank's problem.blowy_lil said:You still should of got ur money back under S75 !!Contact Tesco bank again and re raise the claim/ chargeback for not getting services

OP needs to speak to their travel insurer, as there is no breach of contract on the part of Ryanair.💙💛 💔0 -
Aside from out of time. The flight outbound flight went ahead. So it was the OP who chose not to go. So no chargeback for non receipt as the flight was availableblowy_lil said:You still should of got ur money back under S75 !!Contact Tesco bank again and re raise the claim/ chargeback for not getting services

Travel ins is the only chance.Life in the slow lane0 -
If the return flight was cancelled by Ryanair, then Ryanair should refund you anyway? Unless they are linking the no-show on the outward flight of course.0

I would also be surprised is Car parking & each individual ticket on ryanair were over £100 anyway.
Perhaps Op could confirm?Life in the slow lane0 -
You have no claim as has already been explained. You may have more luck with your travel insurer. Have you approached them? If so, what was their response.flopsy1973 said:I put in a claim on my credit card for the outgoing flight and car parking as we obviously could not go to country that was in lockdown and FCO advised against.
Of course it doesn't. They are completely separate issues.flopsy1973 said:Surely ignoring government advice overrides terms and conditions.0 -
Plus you have to remember the government was saying that they advise you not to travel which doesnt mean you can't. Most often its even only advise not to travel unless its essential (and essential isnt particularly well defined in non-covid times).
Given where our family members live we frequently travel against the governments advice in non-covid times and generally it just means that travel insurance becomes even more expensive but airlines fly to these places most days and it isnt grounds for us to cancel a flight and expect a refund unless we buy a flexible ticket.0
