Evans Halshaw Warrenty Claim

Am all for people taking responsibility for their own actions but it's very easy to fall foul of terms and conditions designed to make a profit for the issuing company.
I know some t&C's are more important than others but there is not enough hours in the day to read all the t&C's we are asked to accept these days"The Holy Writ of Gloucester Rugby Club demands: first, that the forwards shall win the ball; second, that the forwards shall keep the ball; and third, the backs shall buy the beer." - Doug Ibbotson0 -

Damage caused by failure to maintain or consequential damage is NOT covered under this guarantee. Damage caused by weather conditions (flooding/snow/frost etc) Is NOT covered under this guarantee. Failures due to corrosion are not covered under this guarantee. Damage through neglect or vandalism is NOT covered under this guarantee. Not servicing the vehicle to the manufacturers recommendations will invalidate this policy."
Reading this would take you no more than 20 seconds.
And whilst I agree there are a lot of T&Cs in the world, when you're paying for an expensive warranty which in turn could save you many thousands of pounds in repair bills, you need to find the time instead of complaining and whining after the event. If you don't, you're just wasting money.0 -
I agree with you it's in black and white, doesn't stop you having compassion for the ops predicament.
The sevice didn't highlight the impending gearbox failure. Also, eems a bit of a coincidence that the leak appeared and failure happened just after the service"The Holy Writ of Gloucester Rugby Club demands: first, that the forwards shall win the ball; second, that the forwards shall keep the ball; and third, the backs shall buy the beer." - Doug Ibbotson0 -

If the leak is because of the garage's failings in servicing, then that would be up to the garage to resolve, not the warranty.
The other question the warranty will ask is when the fluid was last changed. It's not necessarily part of the service schedule, and may very easily have been missed - especially on a 9yo car with an unclear history prior to ownership.0 -

The OP has probably made the mistake of driving the car. Driving the car causes wear and tear which won't be covered.0

It's odd that the OP delayed servicing when restrictions were less onerous and then decided to do it when restrictions increased. It is an easy get out for the warranty provider but there's no guarantee that a claim would have been successful even if the service had been completed of course.1
