Help to buy

My son in law was badly let down by his developer, mortgage broker and solicitor. In burying a house under help to buy no one advised him
of the process. Subsequent he only found out he needed to complete an application on the 15th December- deadline day. This he did and submitted it at 8pm. He has now been told he was out of time as the deadline was 6pm! No where on help to buy or government websites does it state 6pm. If he had been advised properly he could have submitted this months before as his mortgage and everything else was arranged. When he asked both developer and solicitor if he needed to do anything else he was constantly told everything was in order. He stands to lose thousands of pounds. Help to buy couldn’t answer when asked where it states 6pm - he was told we finish work at 5 as if that was an answer. What recourse has he?

    I am sorry your son feels let down by this situation.  The new Help to Buy scheme started on 16th December for first time buyers, if your son qualifies for that.  The old scheme ended on 15th December as you say, but I assume the application would have needed to be acknowledged by Help to Buy on that date.  By applying at 8pm, the application would not have been seen until the next day, the day the new scheme started.  But also, note the following, relating to the old scheme from the gov.uk website, because the further criteria is that the property is ready by 28th Feb and the transaction completes by 31st March:

    Can I apply for the current scheme before it ends in March 2021? 

    Applications for the current scheme end on 15 December 2020.

    To be eligible to receive equity loan funds:

    • your homebuilder must complete the property so it’s ready to move into by 28 February 2021
    • you must also be able to legally complete the purchase and have the keys to move into your Help to Buy home by 31 March 2021

    Please check with your homebuilder and solicitor that you’re able to meet these dates.
