    The car form part of his estate and any assets in his estate should be used to repay any debts in his estate. 

    Are you positive probate is not required because we’ve now got a car that was solely in his name. 
    Probate(or letters of administration if no will) are not needed for a car.
    Not needed for a house if more than one owner.

    The funeral costs come first out of his estate - his estate seems to consist only of the car and any personal valuables, so very little if any left over for M & S.
    Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.
