Guarantor for family member’s flat rental

    As suggested please post on the housing board for advice about the tenancy ending, they will advise whether the landlord is acting properly in regards to the notice served etc.

    No they're not.

    6 months notice needs to be given unless specific criteria apply, none of which would appear to be the case here.

    An eviction would therefore be unlawful in the current circumstances on this basis.

    Is that correct? They are at the end of a 6 month contract. I thought if another contract is not offered the tenancy ends.

    That definitely is correct.

    By default, the contract will move to a Statutory Periodic Tenancy at the end of this 6 months contract on the same terms. This is within the terms of the Landlord and Tenant Act for residential tenancies.

    If vacating the property is desirable, please see the negotiating tactics in the previous page. I forgot to mention a reference stating that the rent was paid on time and in full right the way through is another requirement. Get everything into writing before agreeing anything, get 2 copies printed, both sign both copies, as LL will require this for tax reasons (it will be a legitimate business expense for him/her), and you may require this if the LL is difficult later on.

     bbl is something he’s looking at. He does have a business account with a bank that deals with them. 
    yes - he’s checking again about benefits, but it’s very unlikely he can claim anything else. 
    No - the letter wasn’t promoted by a request to review rent or anything else - it came out of the blue and was totally unexpected. 
    No - he is not my son, and I said he was under 25, not 25. He has several years yet to go. I’m sorry if it sounds “panic stations”, it isn’t. I have health problems and he is a vulnerable young person. Other than organisations, local authorities, charities etc (which I’ve frequently pointed him towards in the past, and still do) there is no one else he can personally go to. Obviously I don’t want to say more on a public platform. He takes control of things once he knows what to do and who to contact.  It’s no easy for him.  It’s for those reasons I’m asking all these questions now and not at the eleventh hour.
