Hi,
A few days ago, I parked my car in a bay and walked into a building for some information while my wife was still in the car in the front passenger seat. The car was on. I came back out no more than 2 minutes later and got back into the driver's seat of my car. A minute or so later, a man walks up from behind our car, slaps a PCN onto my windscreen, takes a picture of it and walks off. I got out of my car and asked him what I'd done wrong and that he should just have asked me to move my car. He wouldn't answer but I persisted so he said you stepped out of the car to go inside and that means you parked in the incorrect bay so this is why you're getting this fine. It's £60 if paid within 14 days and £100 after that.
I was of course quite annoyed as when I was inside for 2 minutes, he could've asked my wife to move the car.
I'm keen to know if the forum members here think/feel I have a case worth fighting. Please let me know your thoughts on this.
I have attached a couple of pictures:
1. This empty bay is where I was parked for those 5 minutes. It does say "private parking 10 the wharf" and I was there to go to "10A the wharf". I have circled the sign from Premier Parking Logistics in blue. In all honesty, it's not easy to read at all from the parking bay.
2. This is what the sign says.
Thank you.

Date of parking event?
Have you had a postal notification since? If so what is the date showing on it?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thanks for your reply Ralph. I should've looked at the newbies thread first and I will review it.
i wanted to gauge opinion here as i'm unsure if i really did breach their rules by "parking" there (inverted commas used because that's how he termed it).
this car park is in Birmingham city centre.0 -
And the dates ? As asked by Umkomaas
I assume that no postal notice has arrived yet ?
You have fallen into a typical PPL trap
The IPC CoP covers grace periods , do not expect perfect signage on any private car park or bay , PPL are one of the worst companies in this game2 -
Hi Umkomaas and Redx,
The date is 29th december and I haven't received a postal notice yet.
pretty annoying incident. i put it down to the fact that there's much reduced traffic in car parks nowadays so less changes for PPL to issue fines & create revenue. That's why they rushed to fine me lol
What do you advise based on your experiences? How does this trap by PPL play out Redx?
thanks.0 -
I have never received a private PCN or been trapped , it's all what I read on here over 8 years since family and friends have had PCN,s , all of which were BPA AOS companies , not IPC companies
Read the newbies thread , then either appeal as keeper on day 25 or wait for the NTK PCN in the post , then appeal as keeper , any appeal will be rejected out of hand by PPL , so don't expect a quick resolution
PPL have 6 years to issue a court claim pack from the CCBC in Northampton !! That is their current modus operandi
I was surprised when I saw that this wasn't a court claim , haven't seen a PPL PCN for a while , only LBC and court cases recently , so I expect that your will follow the same pattern

Just follow the advice in the NEWBIES FAQ sticky, first post, about the optimal date by when to send in the initial appeal to a windscreen ticket.Your 'story' is irrelevant; your definition of what isn't parking, I am afraid, is misguided. To me, the signage relating to bays 10 and 10A seems reasonably clear. Motorists have to read signage in private car parks very carefully now as a lot of it is designed to catch people out. Motorists cannot continue to believe that they have a God-given right to park their vehicle whenever, wherever, however it suits them. There are traps being set up everywhere, with hardly a private car park without a PPC looking for income from it.This won't go away, it will take a Judge to make a decision, possibly sometime in the next 12 to 18 months, although PPL have up to six years to commence court proceedings - if they financially survive COVID. Many are struggling, there is a reported ~80% drop in income across the sector. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you both for your input. It appears I don't have a case as per their signage. now it's a matter of taking on this bully and drafting letters/emails/appeals so i'll need to think about the benefit of doing so.0
