Fast Track Claim, Quickly Finance Ltd and Joseph James LS

Need some advise please, my wife responded to an advert on Facebook on her phone for mis-sold PPI deadline in August 2019. She answered some basic questions posed by Fast Track. We received the information pack in the post and read through the details and decided not to continue with the process. My wife was bombarded with text messages from Fast Track telling her the deadline was fast approaching and they needed the signed documents to proceed, we ignored this and did not think anything about it until August 2020 when we received a letter from Blackhorse give us a good will payment. Shortly after my wife was contacted by Fast Track wanting payment, she then was sent invoices over the next month demanding money. In December 2020 we received a letter from Joseph James LS threatening court action if payment was not received, I called them and explained that we never asked Fast Track to go ahead and we never returned any paperwork. They said my wife had signed a letter of authority and asked for her email address so that they could send it over. Upon receiving the email the document has a signature which is very close to my wife’s, but when look closer it looks like it’s been lifted and placed onto an open PDF document. What concerns me is how have they got a hold of signature and put onto a document we have not signed. I have then researched the company Fast Track Claim and found they have links with Quickly Finance Ltd and Joseph James LS who act as their legal arm. Joseph James claim the signed document is what they had received from Fast Track and they claim they can prove they sent the documents by email by going back and checking the zip address the documents was sent too. The strange thing about this the only time the got hold of an email address was in December 2020, the date on the declaration was August 2019. How should I proceed, as they are getting aggressive with their demands. To me this amounts to fraud and obtain money through deception.

Quite simply, you’re wife would’ve provided an electronic signature when she signed up for fast track (I.e. signed it with her finger on her phone/tablet screen). The CMCs quite often had wording in there that allowed them to proceed with a complaint following a ‘yes PPI’ result from a lender. Combine that with the fact that so close to the deadline lenders were auto-converting yes PPI info requests into complaints at the direction of the FCA due to the tight turnaround.
the good news is that they’re regulated by the FCA so you’re able to complain to Fast Track and then when/if (when) they reject your complaint you can escalate to the ombudsman. The bad news is that this is currently taking a long time for a myriad of factors and it may or may not be sufficient at this stage to ward off legal proceedings. Someone else will be able to advise you better on this.helpful tips

Thank you for the reply and advise. Just to me it clear at the time of the initial enquire on Facebook my wife was using her iPhone which does not have the facility to capture a signature. And the other point I would like to make Fast Track Claim did not have an email address to send documents to my wife in August 2019, the email details was only provide in December 2020.0

And the other point I would like to make Fast Track Claim did not have an email address to send documents to my wife in August 2019, the email details was only provide in December 2020.If you want an example of how this works, open the notes app on your iPhone, press to write a new note and press the icon that looks like a pen tip in a circle, then squiggle away (works best if your phone’s in portrait mode).On your second point, I find it unusual, having dealt with claims management companies daily for the last 4 years, that they wouldn’t have requested an email address (at the very least) at the point of your wife instructing them to carry out an info request/complaint on her behalf. They excel at data gathering because they would’ve needed a way of haranguing her for any inevitable payout and by data gathering, it’s the only way they can actually find out where she may have had PPI policies.helpful tips

Rather than add yet another thread on these operators, I thought I'd add my experience here.
I have been bombarded by letters from Fast Track Reclaim since Aug 2019. I never responded to any of them and pursued my own PPI claims via the FCA website.
Just before Chrismas, Joseph James Law get involved threatening court action to recover £1991.31. In response to my request for proof of debt, they send me an electronically signed Letter of Authority which bears no similarity to my signature and additionally the previous addresses information is also incorrect. I have responded the same to Joseph James Law.
Other than the FCA ombudsman service, does any one have any additional advice as to how I should deal with these crooks?0 -

There are several different ways that electronic signatures are generated, some are using an input like where you sign on the screen of your iPhone but others are that you simply type your name and it prints in a handwriting like font... I've signed various contracts using Adobe's online solution that uses the text to signature mechanism and it bares no resemblance to my signature but the system tracks various data points to "prove" its me (obviously in civil law its not really prove but simply on the balance of probabilities it was me)
A signature on a contract is a bit of a red herring anyway as there is no legal requirement for a signature in the vast majority of cases.0 -
