Not the driver

Options
Hi, looking for advice.

DCB legal are chasing for a number of outstanding fines from some years ago and have now submitted a LBC. I have reviewed and responded that the alleged occured while another driver had the car. I have offered the details of this driver however they have declined and simply said i am liable as the process has been followed.
Is this correct? What can i do from here? Will this stand up in court?

Thank you

This comes up numerous times and has been asked and answered , including an internet based analysis by a lawyer , I suggest that you read them by using the search box

Only a judge can decide the outcome , in court

Your stance is correct , stick with it

How do we know if ''not the driver'' will be relevant as part of your defence, as you haven't told us which parking firm it is about or whether they have complied with the POFA 2012 or not (keeper liability law).  They aren't ''fines'' and you haven't told us how many years ago (exactly) and which PPC it is.

All of this is explained in the NEWBIES thread (NO LINK GIVEN).  The first post of it, shows how you should have appealed these and not ignored them, and what the significance of Sch 4 of the POFA is about and that some firms don't use it.  The 2nd post of it tells you about this boring pre-court stage...and what to do.

I bet he will do now he wants help on another case!  They're all the same!  CBA to update those who've voluntarily offered their time and expert advice to them. Take everything, give nothing.

    Pet hate!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Did you actually tell them the drivers name and full address, or merely offer?
    precision is key.

In addition, did the person you named admit they were in fact the driver at the time of the alleged event? If not then liability can (in certain circumstances) revert to the keeper.
