Nor is it a penalty

Who advises these companies on PR?

They will have to cancel, they have no  alternative, but they have already done the damage to the village's  retailers.   .
You never know how far you can go until you go too far.

This will turn into a DM crusade I expect and is bound to be cancelled eventually.  I only hope people don't raise money to pay the charge before it gets to court.
These private parking companies have obviously given up on even pretending to be reasonable!

Absolutely. I was horrified when I saw the suggestion - as if this was a statutory penalty the good lady was required by law to pay. The suggestion helps no one!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is not a fine ... and it is not journalism, either, This is from the Daily Mail Online edition, which specialises in 'churnalism' and clickbait.

The article originally appeared in the Newbury Weekly News: Thatcham motorist fined while trying to save dying man - Newbury Weekly News (newburytoday.co.uk) and has basically been cut and pasted from there, no doubt appearing alongside a picture of Kim Kardashian's bum when published in the Daily Fail.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

Two problems here:
wheres the mention of the landowner  that allows this company to operate, that is to where any anger should be turned to
And as far as PPC fantasy robo land goes, she overstayed- popla does not take mitigating circumstances into account so popla will more than likely rule in favour of the PPC.
this section is a worry..
'I am now on anti-depression tablets as a result and I won't use that car park because I get very upset and have flashbacks of the situation.'
With the ongoing effects of covid  more people will be in both a perilous financial state, as well as being in not so good a place mentaly, PPCs on the other hand will be ravernous due to fewer people venturing out to be trapped in infested carparks - a potetiaal recepe for disaster

The DM will probably claim the victory but I emailed Steve Clark about this one and have just had this positive update back - shame we don't know the person involved to tell them how this was achieved (by this forum...again...) but hopefully someone from ECP will write to tell them:

Quick update
The PCN in this instance has been cancelled - rightly so of course.
Stay safe

Typical Daily Fail rubbish:
"In their response, Euro Car Parks told Ms Hutt that the penalty would be held for 14 days before further charges were added."
That statement is a lie they never said that at all.
