Amazon returns policy opened underwear

So got some boxer briefs in a 3 pack for Xmas, tried first pair on and was too small.
What's Amazon's policy on returning these items?

    Hopefully they will refuse to accept. 
    You have used them, even if 7ts just for a few seconds, think about where they hevebee. Even post covid, it's not acceptable. It probably says that somewhere on the ad.

    Lose a bit of weight so they do fi

    Ebay? If 2 out of the 3 pairs have been unworn/untried even if the packet of 3 has been opened?
  • If the size was incorrectly stated in the listing (e.g. the listing said 42" and what you received were 38"), then your statutory rights are not affected and you can claim a refund. If that is the case, then it is entirely possible that Amazon would not require you to return the underwear!
    If it's just a case that you made a mistake when ordering, then I think that they would be excluded from change-of-mind returns, for obvious hygiene reasons.
    I can't imagine that most charity shops would accept anything other than complete, sealed packets of underwear.
    If they have been worn, there are categories on eBay where such items can do surprisingly well, although they would probably need to be black and lacy to achieve the highest prices!

    Assuming this is not a wind up,

    (3) The rights conferred by this Part cease to be available in the following circumstances—

    (a)in the case of a contract for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery;


    If they were sealed and you've opened them the right to cancel no longer exists.

    If they were not sealed then the right to cancel does still exist. 


    Rights lie with the purchaser and timeframe for cancelling under the CCRs may have expired depending upon purchase date, Amazon's policies in addition to your statutory rights can have any (fair) terms.

    Not forgetting that if the handling goes beyond what would normally be allowed in a shop (I can't think of a single shop that would allow underwear to be tried on for size) and the value has been diminished due to this excessive handling, the amount refunded can be reduced to allow for this drop in value and this reduction can be up to the full price paid and in reality, how much is an opened 3 pack of underwear worth?

    I'm sure underwear and beachwear selling stores (physical and online) normally state no refunds unless faulty.

    They may well be a gift from within the same household and the purchaser may be contacting Amazon.
