yeah, they replaced the battery last week on the vehicles 3rd time at the garage for repair.

I have just emailed off my letter to Santander once again, let's hope they reply within the 14 day period and the financial ombudsman gets back to me also with their help

Do you in any case have the option of invoking your Final Right To Reject (for a refund that can be reduced slightly based on the mileage you have covered in the vehicle*)? Absolutely.

* What was the mileage when you bought it, and what is the mileage now? How many of those miles were covered whilst the vehicle was in for "repair"?
