faulty projector and rights

on the 13th of November i bought a new projector from ao.com. an optoma for £800, so not cheap
was fine for almost 3 weeks , then over a period of 3 nights i had issue with overheating messages , sometimes upon switching it on, even though it hd been off for almost 24 hrs, and also after just watching one movie.
so i ring ao who where very helpfull,
i had already contacted optoma via email and had received a response saying that it sounded like it was faulty and to contact ao,
ao aranged for me to have a conference call with  optoma while he was on the phone .
so we did this and optoma said they would arrange for it to be picked up and returned to them. as id only had it for 3 weeks i was in the  return period, and would possibly receive a new model once returned,
so it was collected on the 9th of dec,
upon following the tracking i noticed it was being sent to the netherlands, this arrived on thursday the 17th dec.
today i emailed optoma for an update and was told once its been accessed they will let me know what's happening . and they will send a new one if its deemed to be faulty. albeit dependent on stock, just noticed they are out of stock on this model.

so now ive no projector for over xmas, even if they send one out this week , chances are it won't be here till after new year, even AO  are out of stock.
do i wait or can i contact my card holder and look for a refund and try and get one from elsewhere that have it in stock

  • I'll assume this is a personal purchase and not a business one.   Have you asked AO for a refund yet?  I'd do that before you get your card company involved.
  • it was a personal one.
as i said this is a collaboration between myself , AO and optoma
i assumed it would go to optoma and they would send a new one out once it was returned,
didn't expect it to go to go the netherlands first.
the problem i may come across is that i agreed to send it back . and it was within the period in which i could,
but i still didn't expect to have to wait so long.
xmas isn't going to help my case

You're not going to get a resolution or a replacement for Christmas, so it seems sensible to wait and see what happens with the current projector.  You may also be unlucky with the current goods delays between us and the continent.

If you absolutely need one for Christmas, you could always buy a cheap model and then keep it as a spare or sell it on for what you can get once the first one is resolved.
  • i do have a cheap one that i use for window decoration, but for movies its ok but not brilliant,
i may ring AO and see what they say , when i saw the news regarding the travel bans for freight last night, i thought bang goes my projector if i have to wait for the original one to come back from holland , and then we are ito brexit in the new year,
if they say my own is not faulty, even though i know i was getting these messages of overheating. then i may have to wait for weeks, so ill be demanding a refund if this is the case
