    Abuse of process is just a phrase and some excitable posters built it up into something it wasn't. Forget it. Cases are rarely struck out now.  We still win though.

    Did you just pay in 2022 because the court mucked up telling you about the hearing?

    Do you have another claim being defended now?  What stage are you at?

    What I'm trying to get at is do the courts alone have the authority to have cases struck out, apart from with filing late or non payment of fees etc.
     If I remember rightly someone had posted a general form where it was the court that had the case struck out on the grounds of Abuse of Process. I'd like to find that post.

    I brought a fresh claim which was successful.

    I now seek redress from the courts.

    You wouldn't.  It is well out of date because the VCS v Percy case 2 years ago kind of killed that.  "Abuse of process" is history.

    You seem to have missed what cases are now being struck out for.  It's in the NEWBIES thread (the link to recent strike out judgments is in the a-f exhibits list)  and it's in the Template Defence too.
