What are my rights? Hotel Chocolat

I ordered a ‘cabinet’ of chocolates from Hotel Chocolate back in November for a present. I got an email on Friday saying it’s out of stock and that they’re sending something different instead. 4 smaller boxes of chocolates. However, there was no offer of a refund! Is this allowed? Are they within their rights to send something totally different to what I ordered?! 

I contacted them on Twitter straight away (the email said to get in touch on Twitter) to say I don’t want the other chocolates and I haven’t received a reply. Now I’ve just received an email saying that they’ve been dispatched 🙄

What can I do? Thank you!

    I feel like this is far too easy an answer but.....cancel it? If they haven't sent you instructions by email on how to cancel then check their terms or FAQ if they have one. Or call them to cancel if they provide a number. 

    ETA: have checked their site and you can either use the contact us form or 0344 493 2323.

  • Thank you Unholyangel. Unfortunately they’ve already dispatched the replacement without even checking I’m ok with it. Does anyone know if I order something particular are they allowed to send something different without offering a refund? Thank you 
  • No, you are entitled to a refund if that's what you want.

    You are entitled to a refund if they cannot provide you with what you ordered.

    Can you refuse the delivery? Just email them and cancel (make sure it is in writing). 
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')
