Tyre damage in a private car park
[Deleted User]
Hi this might be a long shot but my tyre was punctured after hitting the kerb in a private car park. I absolutely accept responsibility for hitting the kerb but the kerb was damaged which resulted in the puncture - the tyre would definitely have not been punctured had the kerb not been damaged. As I don't have a spare tyre (stupid feature of new cars!) my car had to be recovered. Would it be worth claiming against the venue that owns the car park? Picture of kerb attached. Just after any advice and if anyone has had any similar experiences. Thanks.

Can you prove the tyre would not have been punctured if the kerb was not damaged? You hit the damaged kerb, it's your fault, no liability for the car park owner2

This forum centres on fighting unfair private parking charges so I suggest you try one of the other forums more suited to customer rights or complaints or consumer affairs.I married my cousin. I had to...I don't have a sister.

One of my tyres was damaged down to the cord, though not actually punctured, in a Sainsbury’s car park a couple of years ago. It was enough to make the tyre illegal and necessitated buying a new one.
The cause was the rusty remnants of an old metal bollard sticking out of the tarmac. I took photos and sent them to Sainsbury’s explaining what had happened. My email was passed around a bit within Sainsbury’s and there was some delay while they got an independent inspection of the car park (fair enough) but within a few weeks they apologised and paid for my new tyre. TBH, I was not really expecting them to pay out but mainly wanted them to fix the car park problem, which they subsequently did. I did not get stroppy or specifically ask for any compensation or threaten any legal action, I just gave them the facts and explained my ‘disappointment’ that my car could be damaged this way in their car park. All in all, good customer care from Sainsbury’s.
I’ve no idea if the OP would have a similar result in their case. What I do know is that there’s not much point talking about it on a forum when they could be talking directly with the car park owner directly. If you don’t ask, you don’t get.3 -

A lot of your posts are helpful and informative, what do you hope to achieve with this game you insist on playing? You never know how far you can go until you go too far.0 -
Not sure I could hence why this is a long shot. I have bumped kerbs before and never had a problem although I know that's no proof. Just thought it would be worth asking! Wasn't sure if the owners would have a responsibility to ensure there's no damage to kerbs? But I've never experienced anything like this before so just wanted to know if it was even worth trying really. Don't want to waste time if its not worth it.D_P_Dance said:- the tyre would definitely have not been punctured had the kerb not been damaged.

Thanks for this. I was really after advice as to whether it would even be worth it. I'm not expecting the car park owner to be very forthcoming but as you say you don't know if you don't try.Mickey666 said:One of my tyres was damaged down to the cord, though not actually punctured, in a Sainsbury’s car park a couple of years ago.
