Sainsburys/ECP NTK served because of overstay caused by Covid restrictions

    I think that they would be insane to take this to court. but if they do familiarise yourself with CPR27.14(2)(g).
    You never know how far you can go until you go too far.

    I've now appealed to the CEO of Sainsbury's and my local MP, on top of having an appeal to ECP rejected. Next step would be POPLA I assume? I have their code on my appeal rejection, and from there I can try and mash together a case using the various links on here.

    Let us know what the CEO says.  The reply will be from one of his staff. 
    M&S use ECP and the CEO does understand the problems ECP causes them.

    Seriously, you do not pi*s about with these people.
    My question to any CEO who thinks parking cowboys helps their business ....
    " Why don't you or your parking agents understand about Covid19 ?  Or would you rather hundreds of people just rush in, spread the virus so they can leave the car park within the time period, please arrange for immediate cancellation and find out why the parking company has no respect for your customers"

    Remember by shopping at Sainsburys, you are paying the CEO's wages, not the other way around

    A man from Sainsbury's CEO office has said:

    "...Sainsbury's will not be taking any further action in regard to this matter. 

    Whilst I appreciate this may not be the outcome you were hopeful of receiving, I trust this clarifies Sainsbury's on the matter."

    Which is him confirming from my previous email that Sainsbury's are, in fact, endorsing violation of their Covid-19 safety protocols in order to shorten the length of customer shopping trips. He would not provide contact details of the store manager when asked, and I no longer live in the area, not that going into a store during another lockdown would in any way be wise just to take the matter up in person.

    Would someone please advise what my next steps would be with this in mind? I find it absolutely sensational that a member of the CEO's office is flat out saying Sainsbury's position on the matter is to go against the protocols in place so as to park for a shorter period of time.

    The daily mail for a start , plus Piers Morgan , plus your MP who should copy in Robert Jenrick MP and sir Greg Knight MP etc

    Also complain to Steve Clark at the BPA , by email too

    Plus do your ECP appeal and then popla

    Sainsburys tend to use Horizon Parking, not ECP these days, so I am wondering if Sainsburys are saying that they don't own this car park and can't influence the PCN because it's not their contract?  If the retail park as a name, Google it and find out which Managing Agents run it and offer commercial units there. It's probably their contract.

    ECP have now rejected my appeal with a blanket response that has ignored the mitigating circumstances. Essentially a button press in an office somewhere because I was over the time and they feel they can still try to enforce the fine.

    Direct email to Simon Roberts' CEO address resulted in a response from a man named Shaun Hodson in his office.

    No, it's a Sainsbury's own car park, run by ECP. Not on a retail park. So even more emphasis on Sainsbury's wanting to essentially charge people for following their own rules!
