Morning everyone,
I found myself with a nice claim from BW legal/ NCP a short while ago. After looking on here I prepared and filed my defence.
Now the problem is I messed up the dates
claim date 10th November
Service date 15th November (5 days after)
now I filed my defence on the 15th December and have just realised it was late.
What do I do!!!! I hope I haven’t messed this up.

You need to check on your MCOL history to see if BWL have filed for a judgment in default. If it's awarded and they seek enforcement, then it's pay in full before the deadline set by the court to avoid a credit crunching for the next 6 years. On a more positive note, BWL may miss the dateline and continue through with the claim to a hearing ............ time will tell.See if anyone else has a view on any way around this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks Umkomaas, I just got off the phone to CCBC and they mentioned no judgement has been filed so my defence has been registered. (Phew) so BWL were not monitoring it that closely!! Thankfully2

So I’ve finally got to the end of this.
submitted my defence in December and it was allocated to my local court.
earlier this week BWL/NCP filed for discontinuance…. Even though they discredited my defence and said they would continue.Now…. Do I take this as a win or claim for costs? I couldn’t see if anyone at this stage had done this before3 -

No hearing date had been set, the last letter I had stated that a judge needed to review and decide next steps (need to dig out the letter)
this was back in February2 -
Chances are that it's discontinued and you will receive an official letter of discontinuance
However , as no hearing date was imminent , you cannot claim costs2 -
Brilliant!ANOTHER BW LEGAL / NCP ONE BITES THE DUST!Come back each week to check if the Government Consultation is open, because people like you will make a difference, as I said here:
https://forums.moneysavingexpert.com/discussion/comment/78462318/#Comment_78462318Please take part.I am sure you have a strong opinion about the level of parking charges compared to Councils and indeed, other Countries where there is no such rogue industry (I looked up some parking fines in Europe and you can pay between 3 and 11euros in Spain to annul a parking fine, and Germany uses a ‘proportionate to the event’ table of charges starting at 20 euros, with parking in a disabled bay being 55 euros). The MHCLG want evidence in people’s responses, they always do. So start building your evidence links and case studies, regulars.Newbies - please take part when it opens even if you merely recount what happened to you and why you think £100 is extortionate.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
